This Letter Report and Visit Record dated 
03/03/2008 to 11/11/2008. 
Several sections of the report have been chosen to illustrate the unfairness of the Chinese legal system as it is dictated by the will of the leaders instead of the law. From these sections, it is apparent that our staff members have been deprived of their rights of information as stipulated in the Information Law of the People’s Republic of China, the Land Resources Law of the People’s Republic of China, and others. The diary shows the threats our members of staff were subjected to. Had I not been aboard, they might have been arrested or taken to mental institutions. Under an unfair legal system where the police--petitioners lodge appeals can be sent to mental institutions for inhuman treatment, the public can easily be subjected to cruel treatment and ill fates…
During the four years, a great number of officials lied to us. The year 2000 report shows that the coal mines to the east, west and south of Mifeng company were exhausted. The only reserve left was underneath the company and to the north of the company. Any further production must come from extracting the coal underneath the company….The coal extraction caused big areas of subsidence and cracks in the production area of the company and many sink holes occurred in the residential area-- these are undisputed facts but the victims are being arrested and circulated as wanted.....

Record of Letter Report and Visit for the Letter Report and Visit Authority

We went to the Letter Report and Visit Bureau of Zhengzhou for Section Chief SUN. When we got there, we called SUN (Mr. SUN Xueliang, the director of Supervision &  Investigation Department of Zhengzhou Report & Visit Bureau, Henan province, China). When we got through, [we] said: “We saw Section Chief ZHOU (Mrs. ZHOU, Director of Supervision & Investigation Department of Henan province Report & Visit Bureau, China) yesterday. ZHOU said he/she had called you, and we can come to you for any consultation.
 SUN said: “What are you saying! You need to trust the government, your city government. Even the city government of Zhengzhou is involved in this matter. It has been clearly said that if [you think] the government
can’t resolve it, including Xinmi and Zhengzhou city governments, we can’t agree to such thoughts. Think about it, your reporting this matter resulted in a special case team sent from Zhengzhou city government, another team sent from the Land Resources Bureau of Zhengzhou city and a third team sent from Letter Report and Visit Bureau of Zhengzhou city. This matter has been looked into again and again. Investigations have been carried out again and again. We have tried to resolve this for you again and again. You can see how much attention and effort has been put into this. If you are still saying the outcome of the leaders’ investigation does not have a legal basis, then I think you yourselves need to think whether there is something
wrong with your personal thinking.”
YANG [Mrs.YANG Liping, deputy General Manager of Zhengzhou Mifeng Paper-Making Co.Ltd(MFP)].   said: “No, no, we are not…The thing is, what is happening, we don’t even know. “
SUN said: “We have been down there to see it. The matter is very clear. [On] some issues we are of the same mind. What is the big problem? You are young and I wonder if you have overreacted. I am being honest
with you. I will talk about the issues with you. Don’t overreact. If you overreact, it is not good for anybody in the future. The Red Letter documents have been issued. Because of this, the Zhengzhou city government has reports, including the problems you are concerned about. You must trust the government.YANG said: “[We] trust the government, but we don’t even know what has been the outcome. How is it that
we are not informed of the conclusion, right?”
SUN said: “The problems you are reporting have been dealt with appropriately by governments at different levels.”
YANG said: “We are the people with the information.”
SUN interrupted her:"I think it is up to how you see this. Don’t overreact.” YANG said: “What how we see this? What overreaction? We just want to know, as you said the matter has been dealt with, why haven’t we been informed of the conclusion?”
SUN said: “You have been informed of this. Xinmi city government has already informed you and asked for your feedback. The hearing has taken place. Zhengzhou city and the mayor (ZHAO Jiancai) have all signed off on decisions on this. Our Zhengzhou Letter Report and Visit Bureau has investigated the matter, The Land Resources Bureau of Zhengzhou has investigated the matter, including your local Xinmi city government has also investigated the matter. The specialists have discussed and approved it. This problem has been dealt with tho roughly.”  
YANG said: “Thoroughly, what’s the conclusion? We are not saying it has not been dealt with. We are grateful for what the government has done.
SUN: “ [It’s] been thoroughly dealt with. Government at all levels have thoroughly dealt with this. You should go home and think about this. Think it through. [Ask yourself] whether this is a personal view problem and maybe not a government problem.”
YANG
SUN said: “Hasn’t there been a hearing hosted by Xinmi city government? Haven’t you been informed? It was very clear and detailed! Don’t overreact on some issues. If your response is overreacting, it will bring you no good.”
YANG: “No, what overreacting? Section Chief SUN.”
SUN said: “You are a citizen of China. We are also citizens of China. For the issue you report, the village, the
county, the city and the province will have certain says. If you still continue with your reporting here and there, if you are still not doing some introspection, we will make a recommendation on this matter soon. Soon we will report to the city government. We will write a report on this. This is not just your personal business, it is a matter for Zhengzhou city and Henan Province. Do you know? The issue you report has been looked into at three different levels and truly and honestly investigated. We have signed off on this. The Party General Secretary of your Xinmi city (Mr. LIU Huanchen, current director of administration office of People's Cogress of Zhengzhou City) as well as the Mayor of Zhengzhou (Mr. ZHAO Jiancai) have given attention to this matter and have issued documents on this. We have reported this issue to the provincial government as well as reported to the Provincial General Party Secretary (Mr. XU Guangchun) and even Beijing (PM. WEN Jiabao). If you are too….”
YANG said: “You have prejudice against me.”
SUN said: “No, I don’t have any prejudice. It is all in your head.”
YANG said: “I came to you because Section Chief ZHOU asked me to.”
SUN said: “Yes, I know.”
YANG said: “We are here to report this issue. You know the outcome but we don’t. Hasn’t the government…”
SUN interrupted by  saying: “Feedback has been given and you should have been informed.”
YANG said:“Yesterday when we saw ZHOU, we did say our local State Resources Company did come to me. But the outcome reported from Xinmi city to you, what is included in the report, there must be a copy here. You can read it.” He said it was different.
SUN said: “It was at Section Chief WEI’s office.(WEI, deputy chief of Report & Visist Bureau Of Zhengzhou city, Henan Province, China). The materials were handed in [there]. The issues you report have been fully investigated. If you don’t think it has been appropriated dealt with, that is your problem.”
YANG said: “We are not saying it has not been dealt with appropriately. We just want to know, as you think it has been appropriately dealt with, what was the conclusion?”
SUN said: “There has been a conclusion on the matter you report. 1. There is no [negative] impact on your company, from the coal mines. Other [aspects] have nothing to do with you. Zhengzhou city [authority] has come to a conclusion. If anything should happen in the future, if it relates to production, the government will bear the responsibility. You just set your mind at ease. But you need to leave your personal view aside. In the future, [if] what you are doing is viewed as an overreaction and unwise move, you will bear the responsibility for it. The issue you reported, we have honestly reported to the provincial government in the name of our government. The issues you reported have been appropriately dealt with, and I will tell you so either face to face or on the phone. This is my principle.”
SUN then went on and on about the same thing without telling us the outcome. He insisted that the problem had been resolved appropriately. Later,
YANG said: “We’d like to look into the safety production license.”
SUN said: “It is not your responsibility. Just mind your own business. This is not what you need to know. Just mind your own business. The issue you mention, can be verified by the Coal Bureau or the Land Resources Bureau, and thoroughly. I have seen it done. You just set your mind at ease. All is accountable.” YANG said: “Will these documents be available to the public?”
SUN said: “Public or not, has nothing to do with you. You are not the coal mine. You are Mifeng Papers. You are claiming somebody else has impact on you. In the end, it is proved there is no such impact. Right? You are now looking everywhere, for a thousand reasons.”
YANG said: “We are only looking for the right reasons.”
SUN said: “You need to have introspection into your behaviour. On your matter, we will report to the government on your matter. We will soon host the Olympics. We need to make recommendations to the government regarding our local instability factors. Anything you are not clear about, I can answer you directly.
No problem with this.”
YANG: “You have not answered directly any of my questions.”
SUN kept on repeatedly saying: government at all levels 1 have dealt with this matter appropriately. I have answered directly all your questions. On what you reported as a document issue, the mine(s) have all necessary paperwork.
YANG asked:“How about the land license?”
SUN said: “Land license, whatever is needed is there.This has nothing to do with you.”
YANG asked: “What do we have the law for?”
SUN: “You go home and think about it! If you still have questions, you can call or consult. You can always ask.”
YANG said: “Ask you for what? Section Chief ZHOU asked us to come to you. You don’t even want to see us. You don’t directly answer all our questions either.”
SUN said: “Chief WEI has already answered your questions. I have answered your questions.”
YANG said: “What answers? The issue to do with Gairong ZHAI (the MFP's staff, one of more than 300 petitioners signed report), [you] may have trouble finding one person, but [can you possibly] have trouble finding all of the others?” 
SUN said: “I tell you, I have many things to do. I can’t possibly review your issue again. It has been thoroughly dealt with. The outcomes you ask for, whatever can be given to you has been given.” He kept
repeating the matter has been appropriately dealt with. [He] asked [us] to leave and think it over ourselves. He said he was wanted by some other leader(s). He asked us to call him back at 2:30pm in the afternoon. He then hung up.
We then called ZHOU, telling him SUN did not want to see us. He insisted the matter has been appropriately dealt with and did not give us any of the conclusions.
ZHOU said he would call SUN and ask about it. ZHOU then also hung up. After a while, we called ZHOU back. No answer. [We] wanted to find SUN. But he had finished work.
Wednesday 07/05/2008
We went to the Letter Report and Visit Bureau of Zhengzhou for Section Chief SUN. When we arrived, we went to SUN’s office to the left of the lobby. The staff member there said they didn’t have Section Chief SUN there. When we showed the staff SUN’s telephone number, we were told that that was not a telephone number in that office. We then call SUN’s office. A female surnamed ZHANG (Public servant of Mr. SUN's department) answered the call.
YANG said: “Greeting to you. I am from Xinmi. Is Section Chief SUN in?”
[Translator note: Chinese reads “matter” and it is probably typo for “all level”].
ZHANG said: “Are you Liping YANG? Section Chief SUN is not in. He is away on business.Just left.” YANG said: “When will he return?”
ZHANG said: “Don’t know” and hung up.
We then called Section Chief ZHOU. No answer. We decided to go to Section Chief ZHOU in the provincial bureau. Around 12:10, we saw ZHOU coming out from the office building. We went up to ZHOU.
ZHOU said: “You are stalking me again!”
YANG said: “We have no choice. When we called you yesterday, you asked us towait. We waited till 11:30 without any call back from you. I called your office and nobody answered the phone. Section Chief SUN said he was busy in the afternoon and we were to call him after 2:30pm if needed. We did and he didn’t answer. The person who answered the phone said he had left for a meeting.
ZHOU said: “After you called me, I called him and told him he must have a talk with you. He said fine.”
YANG said: “You said he is in the big office on the ground floor, right?”
ZHOU said: “He was there.”
YANG: “He was no longer on the ground floor. I don’t know which office/department he is in.”
ZHOU asked: “Do you know which department I am in?”
YANG replied: “Express Investigation Department”.
ZHOU said: “He is also in Express Investigation Department. You know what department I am in but you don’t know what department he is in.”
YANG: “I don’t know him. Yesterday afternoon, I telephoned him and the people there said he was in a meeting. Call back tomorrow! We called after 09:00am the next day, he didn’t even pick up his phone, telling a female to answer the call. As soon as I mentioned Xinmi, she asked if I were Liping YANG. How strange. Never met [her] and how did she knows my name.”
ZHOU said: “He has still not seen you?”
YANG: “The person who answered the call said Section Chief SUN was on a business trip, just left, a last minute trip.”
ZHOU asked: “What do you want to do?”
YANG: “I hope you can tell us directly the outcome. We will then leave.”
ZHOU: “Hasn’t Section Chief MENG [Deputy Director of department of Henan provincial Report & Visit Bureau] told you already?”
YANG: “No. MENG sent us to SUN. SUN was on the phone with us for more than 10 minutes. His exact words were that the governments at three levels had already resolved the problem. The matter had been appropriately dealt with. I asked what actually was the outcome?
 ZHOU: “Section Chief MENG said he had already told you, although some points have not been explained so plainly.”
YANG: “[You] can tell us whatever directly. I don’t want to trouble the leaders.”
ZHOU said: “I heard ”. [Translator note: I interpret it as a typo for “she” from the context. Chinese reads “I said the outcome is …”. I interpret it as a missing character meaning “what”]. from MENG  that Xinmi city government has already announced a decision. A government department, a Vice Section Chief-General of the City Letter Report and Visit Bureau, and two Section Chiefs at the province level have all been assigned to deal with this matter.”
YANG: “Yes, Section Chief-General Sichang WEI [Deputy chief of Henan Provincial Report & Visit Bureau] has been there. But what was the outcome when they returned? We have no idea. As I told you yesterday, the National Resources Company of Xinmi city came to us with a three point proposal. At the time, you said this was different from the report submitted by the city bureau.”
ZHOU: “What decision did MENG give to the questions you raised? Has he not told you?”
YANG: “Yes, she said the mines have a safety production license but are without land licenses which are in the process of being obtained.” I then asked: “If they have the license, could you tell us the license number? She said: “Go and speak to SUN at the City Bureau. During our last meeting, [we] spoke to her about Gairong ZHAI. She had doubts at the time. But when she was asked again this time, she did not give a direct answer and asked us to ask the City Bureau. Yesterday we asked SUN. He said Xinmi city authority had already appropriately dealt with this. He was threatened us by saying it is our problem and told us to think things over. Take our time and think things over at home. If there was any impact, the government would
take the responsibility.

ZHOU said: “I’d contact him again this afternoon. What are you going to do?”
YANG: “Don’t we have the signature(s)?”
ZHOU: “The signature(s) are with her.”
YANG: “Don’t you have access to it?”
ZHOU: “Do you think I won’t get into any trouble?”
YANG: “If this problem is resolved, we won’t need to bother you any further.”
ZHOU: “Let me think about it. You are here anyway.” Then he left.
May 8th (Thursday)
We went to the Letter Report and Visit Bureau of Zhengzhou for Director SUN.When we saw him, he didn’t invite us into his office and took us to a place outside the office (the back door for the Zhengzhou city Communist Party committee). He was eating sunflower seeds while he was talking to us in a sarcastic manner:
SUN said: “Welcome to your visit again. What you are reporting has been appropriately resolved. I only want to say three things:
1. Xinmi and Zhengzhou city authorities have appropriately resolved your problem;
2. The documents of the coal mines are complete and legal; (See Reported Mr.LI Xinde published article, He investigated to confirm the coal mines have no 2 licences of Land and coal mine work safety)
3. If you are not satisfied, then you are the problem.”
YANG said: “If you still insist that the problem has been appropriately resolved, what is the conclusion?”
SUN: “It is concluded. Let me know if there is any point you don’t understand.”
YANG: “I don’t know what the conclusion is from Xinmi city.”
SUN: “You know full well. [We] have already visited you, haven’t you signed? What conclusion do you still want?”
YANG: “I want the conclusion from Xinmi city.”
SUN: “The conclusion has been given to you. What do you still not understand? Firstly, you claimed that the coal mine(s) is/are making an impact on you but it turns out that there is no impact on you. You claimed the documents of the coal mines are not in order but it turns out they are in order. The city government has already established these things. You don’t need to worry about it.”
YANG: “What about the land license?”
SUN: “No land license is needed for coal mine extraction. You check the law, check the books.”
YANG: “Yes, Land license is not included in the 6 permissions needed, but this is not what the Land Resources Law says.”
SUN: “We follow the regulations on coal mine extraction issued by the State Council.”
YANG: “Without a land license, he can use something else instead?”
SUN: “The State Council stipulates that if all 6 permissions are in place, extraction can take place. If you don’t agree, you can speak to the State Council.”
YANG: “Then the land resource law is useless.”
SUN: “We also have our legal grounds. It’s not that we don’t have any legal basis.” (Editor Comment: The government breached the the power;)
YANG: “We know the land license is not included in the 6 permissions. We are clear on this and you don’t need to explain.”
SUN: “Therefore, they don’t have all the 6 permissions for the extraction.”
YANG: “They can, but they don’t even have the land license”.
SUN: “The State has regulations on coal mine extraction. I can only give you 10 minutes. If you are not done in 10 minutes, you can return this afternoon. I can only give you 10 minutes in the morning and 10 minutes in the afternoon. I can’t ignore my work because of you.”
YANG: “Yes. We don’t want to interfere with your work. You can’t keep insisting the problem has been appropriately resolved. Just saying it has been appropriately resolved is not enough.”
SUN: “If you say it is not good enough then it is not good enough? Do we listen to you or the city government?”
YANG: “Here, we listen to you. We can’t get to the city government. We listen to you.”
SUN: “I don’t want to talk too much to you. Look at you, you are not that old, I really don’t understand, Jiancai ZHAO the governor has already signed the paper, black and white, and this is now known to the State Alliance Office (National Level office, it is based on Ministry of Land Resource Administration of China), Provincial Letter Report and Visit Bureau, Provincial Government and the Party General Secretary. Just the three of you keep visiting and you think you can reverse his decision? Go home and lie down, think about it.”
YANG: “There is nothing I can’t understand.”
SUN: “I can disclose this to you, I can clearly tell you that we are drafting, drafting a report to the city government. What the three of you are doing is doing no good for your future. Don’t ruin your lives because of this. If you don’t have anything else, gohome and read books to improve yourselves.”
YANG: “Thank you for your advice.”
SUN:We are drafting this immediately. When it is completed, it needs approval from the city leader(s) before being sent to the city public security bureau. This will definitely be sent to the public security. If I lie about this, I am not a human being. [If] the three of you keep visiting the provincial, the city authorities, if you are not worse off [for doing so], I won't have this job any more. I can bet you my job. Look, this vehicle (pointing at a black car), it is black and you want to say it is white. You need to have your principles. What is the point if you lose your conscience?”
YANG: “We also hope the leaders have your principles.”
SUN: “I respect you, manager YANG. I will give you another 3 minutes before I return. If you don’t leave, I will have to get security to kick you out.
YANG: Now the government has this information transparency system. If I petition
for an issue, shouldn’t I be informed of the outcome?”
SUN:You know full well in your heart. Don’t be a hard nut here. It is meaningless. The problem you petition for, from now on, does not make any sense, it is meaning less. What you petitioned before had some sense. But from now on, it makes no sense any more. Things are being confused. The five points you requested all have been concluded. But you refuse to accept any of them. Now [you] have nothing else to say and are not making sense.”
YANG: “You know the conclusion. Tell us the conclusion then”.
SUN: “Already given to you. I can’t give you any other conclusion.”
YANG: “When was it given to me?”
SUN: “When response was made to your visits, all clear. On that day, you called and reported that the coal mines didn’t have a land license. I can now clearly tell you the mines don’t need any land license. The state clearly stipulates that with the 6 permissions, mines can be operated. What else do you want? What results? Right.OK?”
YANG: Could you give us the reference number for the safety production permit?”
SUN: “No need for me to give you. You can check it up on the Internet.”
YANG: “The thing is [we] can’t find it.”
SUN: “Can’t find it? Go look yourselves. OK? I advise you to stop your visits. Any more visits will ruin you. OK, I will stop here. I have answered all I should have answered you.”
YANG: “What have you answered?”
SUN: “What you are petitioning has been concluded by investigation. If you want to talk with me further, return in the afternoon. When you are back in the afternoon, I can give you another 5 minutes.”
YANG: “What are you saying? You are just trying to manipulate us.”
SUN: “Your petition is manipulating. Don’t you know the problem is appropriately resolved/dealt with?” ( He left after this.)
During this meeting, SUN’s attitude was very unfriendly. Every time before we finished, he interrupted.

我们到郑州市信访局找孙处长(孙学良,郑州市信访局催查处处长),到郑州市局后,我们便给孙处长打电话。接通电话后说:昨天我们见过周处长了,周处长说给你打过电话了,有啥事情可以来你这咨询。
孙说:说啥呀!因为你们得相信政府,你们市政府,郑州市政府都介入这个事了,都已经说得很清楚了,如果说是这个政府做的不到位,包括新密、郑州市,这我们都不会同意,你想想,你一个人说这个事,我们这个郑州市派工作组,郑州市国土局派工作组,郑州市信访局派工作组,对你们这个事反复调查,反复调查论证。可以说是帮过来帮过去,你说对这个事重视不重视。你们说这领导查的结果,如果是没有法律依据。那我感觉你们想想这是不是个人有什么....。
杨(郑州密丰纸业公司副总杨丽萍)说:不是俺不是,您看,关键是现在怎么处理,结果我们都不知道,
孙说:这个我们都下去见过了,这个事都很清楚。有些问题都心照不宣。但有些啥事情,你们作为年轻人,我感觉是不是不要太过了。我是实事求是说的,有问题说问题,这事不要太过了。过头了,将来对谁都不好。这红头文件都出来了,因为这个事,郑州市政府,都有报告,包括你们说的问题,这个一定要相信政府。杨说:相信政府,关键是我们现在都不知道到底怎么处理。您结论是啥,我们都不知道。对吧?
孙说:你们反映的问题,各级政府已经处理到位。
杨说:我们是知情人。
孙打断说:我觉得是你们个人认识问题,不要太过了。
杨说:啥个人认识问题,啥太过了,我们只是问问,就是说你们处理了,我们得知道处理结论吧。
孙说:已经告知你了,新密市政府也告知你了,也征求你的意见了,也开听证会了,郑州市政府,市长对这个问题也签发过。我们郑州市信访局查过,郑州市国土局也查过,包括你们新密市政府查过。有关专家论证过。你们这个问题已经处理到位了。
杨说:处理到位,结论是啥?我们不是说没有处理,我们也非常感谢政府做的工作。
孙说:已经处理到位。各级政府已经处理到位,你回家再想想,反思反思。是不是自己认识上有问题,而不是政府问题。
杨说:我们最起码也知道反映的问题怎么处理了吧?孙说:新密市政府不是已经听证会了吗?不是已经告知你了吗?说得多清楚啊!有些问题不要太过头了,你们反映问题如果太过头了,对你们一点好处都没有。杨说:不是,我们啥太过头了,孙处长。
孙说:你是中国公民,我们也是中国公民,你们反映的问题,乡、县、市、省都有一定的结论。还想到这反映,到那反映。还不反思,这个问题我们会有建议的,马上这个问题,我们要给市政府反映,要写报告,说这个事情。这不是光你个人的问题,而是整个郑州市、河南省的问题,知道不知道?你们反映的问题,经过三级论证,实事求是调查,我们也把关了,你们新密市委书记,包括郑州市市长对这个问题都很关注,而且签发的都有文。我们也给省政,包括省委书记都报过。包括北京。如果你太过了....。
杨说:你对我有偏见。
孙说:没有偏见,是你自己认识的问题。
杨说:我到这儿来,是周处长让来找你的。
孙说:我知道。
杨说:我们来反映的问题,你知道结论,我们不知道。政府不都是。
孙打断说:这都回访了,也告知了。

杨说:我们反映的安全生产许可证。
孙说:不是你们管的。
孙说:谁的事谁管,不需要你们知道。管好自己的事就行了,你说的问题,煤炭局,国土局都可以查,而且查的很清楚。我都见了,这你放心。有担待。
杨说:那这各种证件是不是应该公开。
孙说:公开不公开,给你没啥关系。你不是煤矿,你是密丰纸业的,你反映的是人家影响你。结果人家不影响你,对不对。你现在找这,找那。找一千个理由。
杨说:我们找的都是正当理由。
孙说:你们要反思自己的行为。你这个事,我们要给政府打报告,针对你这个事。马上要开奥运会了,我们要对周边不稳定因素,我们要给政府建议。你对问题不清楚了,我可以正面回答。这个没问题。

我们到郑州市信访局找孙处长。到市局后,先到接待大厅左边的办公室找孙处长,里边工作人员说这里没有孙处长,把孙处长电话给她看后,他回答说:不是这里的电话。随后我们打孙处长办公室电话。接电话是一位姓张的女性。
杨说:你好,我是新密的。孙处长在不在?
张说:你是杨丽萍吧?孙处长不在,他出差了。刚走。
杨说:那他什么时候能回来啊?
张说:不清楚,挂断电话后。紧接着我们给周处长打电话,没人接听。我们决定到省局找周处长。约12:10 分见周处长从办公楼出来。我们走上前。
周说:你们又在这截我呀!
杨说:我们也没办法。昨天给你打电话,你说让等会儿,等到11:30 分你也没给我回电话。我给你办公室打电话,也没人接。孙处说下午有事的话让2:30 后给他打电话。我们给他打电话,他没接,接电话的人说他开会去了。
周说:你给我打电话后,我给他打电话说:你一定要给她们好好谈,他说中。
杨说:你说他在一楼办事大厅,是吧?
周说:原来是在那的。

今天去市信访局找孙处长,见到孙处长后他没让在办公室谈,把我们带到办公室外边(市委后门),很不耐烦的样子还磕着瓜子,带着讽刺的口气说:
孙说:“欢迎你们三个继续跑哦,你们所说的已经处理到位,我只说三句话,第一:你们所反应的问题新密市政府郑州市已经处理到位,第二:煤矿手续齐全是合法的,第三:你们认为不到位是你们认识问题”
杨说:你要还是这个态度说已经处理到位,那结论到底是啥?
孙说:有结论,你说吧对那一点不清楚你可以给我说
杨说:新密市报上来的结果俺都不清楚
孙说:你很清楚,已经回访你了你不签字,你还要啥结果?
杨说;俺要新密市往郑州报的结果

In March 2006, a coal mine near to Mifeng Company lowered a mine shaft not far from Mifeng. The then head of company went to see Chunjie YANG, the chief of the Coal Bureau, and the shaft was closed down on the same day. In May 2006, the shaft was opened up again. Over the next two years, Mifeng kept appealing to higher authorities on this issue. It was only after repetitive written instructions from the
Provincial Party General Secretary that the shaft was eventually closed down and facilities flattened. On the first occasion, it was closed down on the same day while on the second occasion, it was only after persistent pursuits over two years that it was closed down. Two occasions and two very different experiences. From these one can easily see that Chunjie YANG, the chief of the Coal Bureau of Xinmi, had taken a
bribe on the first occasion but he tried to conceal the bribery by pretended to settle the matter in a business-like manner taking the side of the victim, but in fact he was in bed with the mine owners. This is the true him. Chunjie YANG, the chief
of the Coal Bureau of Xinmi, is related to Liuyi HUANG, a shareholder who was actively advocating against Fengmi company. These two men have been in cahoots with the mine owner(s) to conspire to create instability for the company. Particularly YANG, who protects the interests of the mine owners, losing his impartiality as a government civil servant. Currently in Xinmi, it is well known
that YANG does not accept bribes lower than 200,000 RMB. In recently times, YANG had been accused of failing to deliver after taking the bribe(s). Hard to know how much YANG has taken as bribes from the mine owners. He now instructed his relative to provoke discontent amongst the shareholders so as to bring down Mifeng, achieving the goal of the mine owners—wait till Mifeng company collapses before they move in for the coal extraction. As a relation to YANG and having received favours from the mine owner(s), HUANG defended YANG against the accusation of “failing to deliver after taking the bribe(s)” by acting on behalf of YANG, jumping from behind the screen to the front and daring to show himself unmasked in initiating
acts to bring down Mifeng. One can understand the motives of HUANG in trying to bring down the company. YANG has huge unaccountable wealth and is nicknamed “Gold Vault YANG”. FAN, a big mine owner in Xiazhuang River, is also from Pingmo. FAN claimed that YANG was secretly supporting him. YANG would do anything for him as YANG had shares in his mine. It is well known that YANG has assets worth more than 200 Million. We demand an investigation into his assets. How can it be possible for any public servant to command such an income? In addition, YANG is somebody who rose from being a farmer working with a cart to becoming a party branch secretary through bribery, then became head of the village and now
holds the very profitable post of the Chief of the Coal Bureau at a time when the coal price is soaring. [Page 2] During YANG’s process of buying his posts, he repeatedly consulted HUANG and asked for his help. When he ran for the people’s representative for Zhengzhou city, he provided money to HUANG to bribe voters. Even HUANG himself has repeatedly spread the word about how YANG bought his various posts. Hard to believe a person like him who is under 50 years old and has 3 children (in violation of the family planning regulations), rose again and again from being a farmer operating a cart to being the Chief of the Coal Bureau. From this one can see YANG is very capable and skilful in the art of bribery. During the spring
festival of 2005, in a card game, a mine owner loaned 1.8 Million RMB to HUANG in honour of YANG to ensure the cash flow for HUANG’s Shuanghui chain stores. This was what HUANG told the Chairman of Mifeng. In Xinmi, there is a true story that when a mine owner wanted to withdraw a huge amount of cash from Xinmi City Industrial and Commerce Bank Branch right before the branch closing time, the bank
staff turned down his request. The mine owner then threatened to close down the bank. This shows what HUANG said was true. This also suggests the Shuanghui chain stores owned by HUANG are in fact YANG’s money laundering machine which helps legitimise YANG’s money.
During 2007 when we went to Beijing to report the wrong doing of the mine [owner(s)], it was YANG who bribed authorities in the departments in Beijing with the actual amount of 100,000RMB while he demanded 500,000RMB from the mine owner(s). He helped in covering up the wrong doings of the mine owners to
discourage us from our legitimate reporting to authorities. The first person who proposed for the mine owners to buy Mifeng company and provided the name of the owner(s) was HUANG. Looking back one realises HUANG was in fact negotiating on behalf of the mine owners with Mifeng. They shared common interests trying to sell out the interests of all shareholders of Mifeng. By helping the mine owners bringing down Mifeng, the mine owners would be able to extract the coal sitting under Mifeng without having to pay a penny. Mifeng itself is of no interest to him. After receiving bribes from the mine owners, he went all out to work for the mine
owners. Recently, he even hosted a welcome banquet for Quanxi MA, who had embezzled over several hundred thousand RMB from Mifeng company and was being exposed on the internet, and was in cahoots with Wenliang SUN and spouse who had embezzled more than 100,000 RMB of the company’s money. The reason that MA could return to Xinmi was that YANG instructed HUANG to reassure MA. It is learned that YANG told somebody that releasing MA was like setting off a dog to bite Keji XU. SUN and spouse were not afraid of visiting the public security bureau even if they were involved in embezzlement of over 100,000RMB for unauthorised sale of cigarette papers of the company, all because they had been promised by YANG and YANG’s bribery and encouraged by them. YANG had also conspired to feature the 3
interviewers in the news coverage on General Secretary LIU’s receiving visitors’ day activities. Amongst the three, two were probably suspects who had accused Mifeng[Page 3]—one of them is the wife of a suspect being circulated on line—of illegally covering up; the other one was Wenliang SUN and spouse who had secretly sold the cigarette papers. This is a deliberate defaming of LIU—so that the public thinks it was LIU who was supporting the criminals on the run. Because YANG defamed LIU and Xinmi, is YANG still worthy of the title of a national civil servant? Not only did he mastermind for the two suspects to visit LIU during his Public Visit Reception Day but also deliberately leaked this information to Mifeng, encouraging Mifeng reporting the wrong doing of these two suspects on the same day-- August 8th –the day LIU received visits from the public. He organised all this in order to defame party general secretary LIU. It is obvious that YANG must have received substantial bribery from the mine owners and why he went all out helping the mine owners to bring down Mifeng. We believe a party general secretary like LIU would not tolerate somebody like YANG, a rotten apple mixed with other honest public servants and damaging the interests of the state as well as the reputation of Xinmi.
On 19/08/2008, HUANG’s group of gangsters, in the name of delivering a notice by distributing leaflets, defamed the company leaders at the company site as well as destroying documents on the company’s communication board and damaging the company’s properties. When the guards tried to stop them, HUANG attempted to assault the head of security. He even pointed his finger towards the leader threatening: “[He] will follow you even to a new country.” Before leaving, he shouted that he was a member of the political  consultation committee, meaning nobody could do anything to him. In fact, HUANG often acted in the name of such a member, claiming his activities were backed by Chairman LU of the Political Consultation Committee of Xinmi and his instructions were directly from LU. All such activities were aimed at bringing down Fengmi. We believe a good Chairman like LU would never mix up with HUANG, who only sought his own personal interests by using the cover of an honest committee member and whose behaviour damaged the reputation of the committee. Chairman LU would not allow a person like HUANG who had traded his conscience and morality for personal gain to stay being part of the political consultation team.
As the list of YANG’s wrong doings is endless, we strongly urge the authorities to investigate YANG’s huge assets and find the sources of his massive wealth. To investigate his accepting bribes and selling out the interests of the nation. The above mentioned wrong doings are only the tip of the iceberg. We reserve our disclosure of the huge amount of facts leaving him a chance to disclose such matters himself. We also sincerely warn Chunjie YANG that turning himself in is the only option he has.
The evidence we have against him is very strong. The party disciplines and the national legal system will never let him go unpunished! All of the staff members and Mifeng company have been forced to the end of our tether. We are willing to relocate but we only ask for the continuity of our production and our livelihood. Our right to survive has determined that we will never give in. This is a battle between justice and injustice, between protecting the national interests or harming the national interests. We will fight to the end to bring down Chunjie YANG—the rotten apple of the nation!

Inconclusive Outcome for some Government Departments’ Dealing with the Illegal Mines in Xinmi City, Henan Province

As can been seen this article,  readers would be understood and know how to Xinmi government treated illegal mining. Readers would to know which officials are real abused power and why today Chinese authority punished people are scapegoats for Dongxing coal mine accident killed 25 miners in Zhengzhou, Henan on 15th March 2010.

On06/06/2008, the Media Supervision Site of China published a report entitled “Three Orders from the Provincial Party General Secretary Still Could Not Put an End to the Illegal Mining” telling the story of how the Supervision Office of Zhengzhou, Henan totally ignores the illegitimacy of the coal mine(s) and claims, in their verbal response to the appellants and in their report to superiors, that Xinxing Coal Mine Ltd. and Zhaigou Mine of Xinmi City “have all procedures in place” even though the mines do not have safety production licenses. Such a conclusion is purely adding insult to injury as their mining has resulted in  subsidence and distortion of walls in the local residential housing and the commercial properties, as well as having negative environmental impact.
When this story was published on the Chinese Media Supervision Site, it caused a stir nationwide. Zhengzhou City Government quietly looked into the story. Before the Beijing Olympics, we received letters from victims, including some villagers of Zhaigou village and some employees of Mifeng Papers (MFP) Ltd. of Zhengzhou, who had to live in dangerous housing, claiming: “The update on the two illegal mines is: Xinxing old mine has stopped production but has not pulled down its headframe while headframes of the old mine and shaft
at Zhaogou have been pulled down.” This means that as the Olympics was approaching, to play safe, they reluctantly made some compromises for show. Once the games were over, they could continue as usual.
Even such small compromises meant a lot to the victims. The following describes their hardship during their appeal visits: The victims from Zhengzhou Mifeng Paper-Making Co. Ltd. (MFP) company who had to live in dangerous housing started their appeal in June 2006. They approached authorities at different levels and their appeal was looked at by the leaders at national, provincial and city levels and commented on with their
instructions. But when the instructions were handed back to the Xinmi authorities for enforcement, enforcement proved difficult. For example, the issue was transferred from the Letter Report and Visit Bureau of Xinmi to the Land and Resources authority. It is known that the Land and Resources authority is not responsible for safety issues, neither of coal mines nor the land-- it is not entitled to enforce or supervise the administration of coal mines or land issues. This is obviously a game, as there are probably a few individual officials protecting the mines.
On 28/03/2008, representatives for the victims from Mifeng (MFP) company reported the issue to Deputy Bureau Chief WEI of the Letter Report and Visit Bureau of Zhengzhou. WEI told them the case was judged inconclusive in 2007 as his bureau sent personnel to the company but failed to find the person who filed the appeal. As the appeal letter was signed by several hundred people, why not contact anybody else? It is hard to believe the case was inconclusive for such a reason. But is it not easy to guess its implications?
Around 3pm on 13/05/2008, the above mentioned representatives received a message from the Letter Report and Visit Unit of Xinmi Land and Resources Bureau, telling them to return to their office to be notified of the settlement on the illegal use of farmland by Zhaigou and Xinxing mines. But within one hour, around 4pm on the day, the bureau changed their mind and informed the representatives that it was no longer necessary for them to visit as the documents had been transferred to the Letter Report and Visit Bureau of Xinmi. They could go there instead, should they wanted to follow it up.
On the morning of May 14, the representatives went to the Letter Report and Visit Department of the Land Bureau. WANG, the head of the department, told them: “The case we received from the Letter Report and Visit Bureau was an anonymous report. The outcome of the investigation has now been returned to the Letter Report and Visit Bureau and they could follow it up there.” When they got there, the head of the bureau there said: “The case was dealt with by the Land Bureau. We are only assisting. For details, you go to them”. The
victims were being treated like a football, being kicking around with no way of finding out the decision.
On May 20th, the representatives eventually got to Jiansheng ZHANG, bureau chief of the Letter Report and Visit Bureau. ZHANG told them: “I won’t give you the outcome. It should be given by the Land Bureau. If they don’t, you ask them to come to me. We must follow the procedure. The Land Bureau is directly responsible for your issue. You should get a decision from them. We are only reporting the decision to our superiors.”
In order to clear the hazardous conditions surrounding them and to ensure their safety, the people of MFP, who lived in dangerous housing and who have been appealing/petitioning, have gone through all levels of authority in a persistent manner, regardless of the ill treatment they received from all of them. In order to comfort the very distressed employees and shareholders, for the stability of the society and harmonious development, MFP agreed to a substantial compromise: “As long as two productions lines can be established for uninterrupted production, all compensations can be settled after the mines can resume production.” Perhaps the mines have had too many such “small expenses”; they refused the authority’s above proposal by claiming to be “not capable of paying relocation compensation”. Being put into such awkward situation with no option left, MFP management had to allocate key people to organise appeals/petitions from victims, telling them to rely on the party and the authority for justice and appealing/petitioning through official channels to
prevent unexpected incidents. In accordance to the Letter Report and Visit Law of the People’s Republic of China, the authorities should respond in writing to the appellants/petitioners. But the victims from MFP have not yet received any letter or any instructions from any authority.
On May 26th, 2008, what the victims managed to get from the Letter Report and Visit Department of the Land Bureau of Xinmi was nothing more than a verbal settlement recommendation/decision.In the afternoon of September 22nd, 2008, in the office of the Letter Report and Visit Department of the Land Bureau of Xinmi, the representatives finally were shown the long awaited written recommendation/instruction. WANG, head of the department, instructed a member of staff to present them with a paper: “ Report on issues related to Xinxing Coal Mind Ltd and Zhaigou Coal Mine of Xinmi, dated Sept.4th, 2008” (please note: the report
was not a red letter document endorsed with a official seal. Please refer to the appendix). They were told it was impossible to show them the original document or to be given a photo copy. They were only allowed to read that document in the office.

The following are the different views of FMP victims on the “Decision Report of the Land and Resources Bureau of Xinmi on Issues Related to Xinxing and Zhaigou Coal Mines, date Sept.4th, 2008”:
1. In June 2006, MFP started its tip off reports on the two above mentioned mines. At that time, the extraction licenses for the two mines were expired. They didn’t have any environmental evaluation and other relevant documents and procedures in place. Therefore, both were involved in illegal mining. This report shows that such documents were obtained after the tip off report and exposure from the media: for example, the safety report for Xinxing was approved in July 2006, the construction design was approved in August 2006 and the extraction license was not obtained until October 2006; Zhaigou coal mine technological renovation plan was approved in June 2006; safety plan was approved in Sept. 2006, while construction design was approved in Oct. 2006. The report does not show when Zhaogou mine was granted their extraction license. It is obvious that the two mines didn’t have extraction licenses back in June 2006 when they were being reported.
The state requires: obtaining licenses before mining. How is it that the mines obtained the relevant permissions after they had been reported, and exposed by the media? How is it that the mines that should have been closed down still stayed in business and caused major bloody damages? We could not help thinking deep into it! MFP victims and their families strongly urge [you] to hold the relevant department heads responsible for what they did.
2. Legitimate mining requires all 6 permits. But in this report, it claims that the two mines have only 4 permits, which makes their mining totally against the state requirements. Until today, the two mines still have not got production safety permits. Also, why does the report make no mention of the safety risks the mining posed to the dormitory building(s) of MFP? The report deliberately avoids mentioning the required safety permit. Being without a safety permit was behind the collapse in a mine of Xinta Mining Ltd., Xiangfen County, Linfen City
of Shanxi, costing 254 lives, all due to long time production without any safety permit. To put people’s lives first, such tragedy can’t be repeated. We appeal to the authorities to close down businesses without the appropriate production safety permits.
3. A manual on site survey of the land acquired by Xinxing coal mine, the old mine, the new entrance and the filled-in entrance, discovered 197 mu of illegal land use, including: 30.1 mu of land taken by the old mine and technologically renovated mine of Xinxing, all of which is basic farmland (including 25.3 mu of the basic farmland; 4.8 mu of deposit water flooded land ); 120 mu of damaged basic farmland due to the subsidence caused by Xiazhuanghe Mine of Chengguan Town, Xinmi, the former company of Xinxing; basic farmland 1.8 mu filled in 150metres south of MFP, belonged to Xinxing mine in early 2007; 45 mu of “leased”land suspected of inappropriate use in Xinxing Estate; while the report only mentioned the size of Xinxing mine being 16.54mu, 80.5 mu less [than the manual surveyn found] and far from reality.
A manual on site survey on the entrances of the old mine, the ventilation shaft (former Eighty One Mine) and technologically renovated shaft found a total of 53 mu of land used and damaged (including: 10 mu of general arable land, 25 mu of basic farmland and 18 mu of subsided basic farmland). But the report mentioned the size of Zhaigou Mine was only over 12 mu, a 41 mu difference, and far less than reality. A comparison on the three reports and suggestions/instructions issued by the Land Bureau found that in the penalty notice issued in July 2008, the illegal use land was 24.7 mu, which is 8 times the illegally used land of 2.89 mu mentioned in the penalty notice issued in July 2007. The report briefly explained such difference was due to the malfunction of GPS devices. MFP asked for GPS experts to look into the malfunction claim: when it occurred on
02/04/2008, was it due to any human error or was it a true malfunction issue? This casts doubts on the credibility of the individual land authority officials. How can such a poor GPS report pass through Xinmi City, Zhengzhou City and Henan Province authorities and all the way up to Premier Jiabao WEN? Putting on such a show, was it the doing of the so called “Government No. 2”, the government manipulated by the two mines?
The report dated July 2007 submitted all the way up to Premier Jiabao WEN has become a thing of the past. The public is not interested in seeing the people being punished, but the 24.7 mu of Zhaigou mine measured incorrectly by the faulty GPS is only half of 53 mu, the measurement from the on site manual survey. The size of Xinxing’s actual illegally used land is 8 times to that of the claimed used size. Can we ask the land authority to check the accuracy of the GPS measurement by the technical supervision department before submitting
it all the way up to the central government, so as to keep the credibility of the state?
4. Xiazhuanghe Mine, the former company of Xinxing Mine of Xinmi, caused the subsidence in the foundation of Tianda No.3 Paper Plant, an over 7 Million [yuan] investment by MFP as a major shareholder. Cracks and subsidence were caused in the production area which led to the eventually closing down of the paper plant. The report certainly didn’t mention this harm done and any punishment given. We ask you to take the appropriate legal punishment.
5. Unbeknown to FMP, 1/3 of its land had been transferred to Xinxing mine. This is a serious “illegal approval” and an act of abusing power. It was this illegal approval that caused the dispute between the two companies and brought instability to the society. Due to the intervention of the provincial general secretary of the party, the boundary was re-drawn in 2007. But this serious offence should not go without punishment!”
The report suggests: “Xinxing Mine took the initiative to ask the Land and Resources Department to narrow down the size of their mining area so that its legitimate mining area is[only] within the production area of MFP so as to avoid subsidence caused to MFP by under ground mining activities…” Therefore, it can be concluded that the Land Bureau already acknowledged/accepted that some land of MFP had been taken over by the coal mine unbeknownst to MFP and was a “sure thing”. Shouldn’t somebody look into such a serious violation of the law? Shouldn’t somebody ask who had given the approval by breaking the law? Whose doing leads to the dispute between the two companies? The report suggests: “Xinxing took the initiative to close down two construction shafts which brought in over 1.5 Million CNY now lost to the mine in order to avoid further escalation of the conflicts between the two parties.” In fact, the down sizing of the mine took place in August 2006. The pulling down of the headframe only took place after instructions from Guangchun XU, the party general secretary, was give, and under the on site supervision of Yuefei CHEN, team leader of Zhengzhou city investigation team. It took a whole year before the landscape was restored in August 2007. The dispute between the two parties was caused by the illegal approval given by the Land
Authority. In this dispute, the direct loss caused to MFP was 9 million CNY, 6 times of the cost to the mine. But the report took the mine’s side and was biased in presenting the facts. It is hard for the public not to doubt the fairness of the report.
6. On important issues such as the relocation compensation for the nearby villagers, the information in the report is totally untrue. We urge you to look into these issues! (Please refer to survey report(s) on Xinxing district/estate). The report suggests: “The two mines lease/leased 44.8 mu of construction land in Qingshihe Village, Xidajie Office, for 50 years” which is in fact a take-over fronted by leasing, which is clearly banned by the state. This shows another of their violations of the law. We urge you to make it right, and to return the
land belonging to the public so that they can rebuild their homes and communities. Fifty four families in Zhaigou village needed to be relocated, but only two of them have actually relocated, which accounted for 4%; the compensation payable is 1.47 Million [CNY] with some of it still not in place; the so called 8 Million [CNY] Xinxing Estate project received actual investment of only 1.15 Million and the housing is/was built/funded by the public. The survey shows a serious degree of dissatisfaction from the villagers/public and
they are not confident when they will be able to move into the new estate (refer to the survey
report for details).
7. The penalty decision(s) and other penalty procedure issued by the Land authorities and other authorities are not accessible and transparent! The receipt(s) for the penalty payments from the mines to the Treasury, and the decision on the mines and their key personnel are not in the public domain.
The illegal approval resulting in the dispute between the two companies and the delay in investigating the wrong doings of the nearby mines have helped the two mines thinking they are actually running “Government No. 2”. No wonder people like Liuyi HUANG, the brother in law of Chunjie YANG, the chief of the Coal Bureau, got his hands dirty by taking a dozen henchmen to create the world shocking “Sept. 6th Mifeng Bloodshed Incident”, causing 6 injuries, with one minor injury and other unconfirmed injuries (Forensic   valuation document(s) are filed with Xinmi Chengguan Police Branch. The victims could not get a copy even after repeated demands). The public and the victims get down on our knees to beg the Land Authority to carry out a “factual” investigation to avoid things such as the malfunction of the GPS, so as to prevent
the “Sept.7th” assault, damage and taken by force incident in 2000 and “Sept. 6thbloody Incident” from re-occurring to MFP! We appeal to the authority to carry out an expeditious and effective investigation, and tighten the regulation on Zhengzhou’s technologically renovated mines, so that a major fatality mine incident [such as the one] costing 37 people’s lives in Xinfeng No. 2 mine/2 mines of Zhengzhou Guangxian Industrial and Trade Ltd. of Dengfeng, Henan, will not happen again in Zhengzhou.
All and all, MFP’s generous compromise is aimed at achieving a win-win for the two parties, for the local resources to be effectively utilised, for the local government to benefit from the tax income, for the mine to be prosperous, and for welfare of the employees of MFP ”. By doing this, a stable and harmonious society can be created.

Report 1: investigation report on the tip off from Xinmi city MFP employees Decision on Xinxing Mine:
In Feb. and Sept. 2007, three plots illegally taken totalled 16.54 mu, including 10.23 mu of basic farmland and 6.31 mu of construction land. This is a suspected violation of the “Land Administrative Law of the People’s Republic of China” and the suspect had been reported/ handed over to the law enforcement authority.
Decision on Zhaigou Mine:
1. Within 15 days, take down the buildings on the 794.89 m² plot and the old ventilation shaft headframe and the shaft as they have illegally taken basic farmland and general arable land. Restore the land back to its arable condition.
2. Confiscate the buildings on the 1838.56 m² of construction land illegally taken by the mine, and the new main shaft headframe, the shaft, the ventilation shaft headframe and the shaft, the old main shaft headframe and the shaft.
3. Fines on the illegally taken 3120.5 m² basis farmland at 25CNY/ m², subtotal 78,012.50 CNY; on the general arable land of 923.9 m² at 10 CNY/ m², subtotal 9,239.00 CNY; on the construction land of 12,452.8 m² at 7 CNY/ m², subtotal 87,169.60 CNY; total fine of 174,431.60 CNY.
Report 2: Investigation report on the tip off from Xinmi city MFP employees
On 01/08/2008, the representatives of MFP victims was verbally given the following penalty decision by a member of staff at Enforcement Department of Xinmi Land Bureau: The bureau had issued “Penalty Decision on the Land Administration”, Xinmi State Land and Resources Ref [2008] No. 016, dated 20/07/2008:
1. Take down the building(s) on the 610.45 m² of general arable land illegally taken within 30 days.
2. Confiscate the building(s) on 1531.32 m² of construction land illegally taken, and structure buildings (the new main entrance headframe and the shaft body, the ventilation shaft headframe and the shaft body)
3. Fines on the illegally taken 17.10 m² basis farmland at 25CNY/ m², subtotal 247.50 CNY; on the general arable land of 873.90 m² at 10 CNY/ m², subtotal 8,739.00 CNY; on the construction land of 7347.90 m² at 5 CNY/ m², subtotal 36,739.50 CNY; total of the three is 45,906.00 CNY [unplanned].
4. Order Zhaigou Mine to restore the land that has not been restored properly within 15 days.
Xinmi State Land Bureau claimed it had delivered the Penalty Decision on the Land Administration to the Mines on 23/07/2008, within the legal requirement deadline. As of the drafting of this report [from us], no information on the execution of the [penalty decision] report is available in the public domain.

Prosecuted Scapegoating of public servants for senior corrupt officials  from the real cause of the mounting death toll in Xinmi Dongxing coal mine grave accident.

Attention is this article said the officials are not real officials. They are public servants. As can been seen, China People daily reported on 17th March 2010 entitled "officials sacked over coal mine fire tragedy" http://english.peopledaily.com.cn/90001/90776/90882/6922024.html  

The sacked officials are:
Fan Ruihui, governor of Niudian township where the mine is located;
ZhuXinxian, another township official in charge of work safety; 

Pei Guoqi, a deputy director of Xinmi coal mine bureau. Pei Guoqi, a deputy director of Xinmi coal mine bureau. 
Those officials that only one, ZHU XInxian is treated as bottom class of officers (He has no official title and position)  is prosecuted even so they have been made scapegoats for the real backers of coal mines. In a result, the Chinese authority punished the scapegoats of scapegoats. There is no one of real officials have been punished even so they spent seven months to investigate. It intends to gain fame by deceiving the public.

The 2010 Dongxing Coal Mining Co. fire was an incident that began on Monday, March 15, 2010, in the Xinmi, Zhengzhou, People's Republic of China. Twenty-five miners died during the incident which, among other things, resulted in four local officials being removed from office.
The fire began at 8:30 PM on Monday when electrical cables in the main pit caught on fire. Shuhe Wang, Deputy Director of the State Administration of Coal Mine Safety, said that mines that are being rebuilt were strictly forbidden from producing coal, but the Dongxing Coal Mining Co had ignored the ban and resumed production without a license. Wang blamed the incident on coal safety officials' lack of supervision.
A week of coal mine disasters in China
On 2nd April 2010, at least 19 miners were killed and 24 trapped by a mine explosion in the central Chinese province of Henan on Wednesday evening. It has been a bloody week for China’s coal industry, with four reported accidents.

Henan provincial governor Guo Genmao personally took charge of the rescue and insisted that the trapped miners could possibly be saved.
According to the Henan Work Safety Administration, the mine was ordered to suspend its operations last May after a gas outburst that killed two miners. Four officials were sent to the mine to enforce the ban, supposedly on a 24-hour basis, but the mine continued production. None of the officials reported the illegal action. This is not true. in Zhengzhou Mifeng Paper-Making case, It petitioned for near 4 years even so it had 2 teams lived in the Beijing for petitions. It never affected the small coal mines' operations. They submitted bogus report pass through Xinmi City, Zhengzhou City and Henan Province authorities and all the way up to Premier Jiabao WEN. Putting on such a show, was it the doing of the so called
“Government No. 2”, the government manipulated by the two mines?
The four officials disappeared after Wednesday’s disaster because it can avoid to expose who are real "protect umbrella". In the MFP case, the head of gangsters Mr.CHEN Jiwei hired by corrupt officials and coal mine owner CHEN Haichao' man. He led to attack the MFP. one of the Sept.6 Bloodshed incident victims, wanted to submit an application asking Xin mi police to strongly request Chengguan Police Station be challenged in the processing of investigating the assault committed by Changfu YU, Junjian LU and Jiwei CHEN and others. But Xinmi police was against the law to refuse to accept an application.
On Oct. 22nd, 2008, Jiwei CHEN, the key suspect wanted by the police, was at large and there was no progress on the case of 9.6MFP bloodshed incident. MFP’s informant in the mines told that Jiwei CHEN was actually under the control and protection of the police and they didn’t want CHEN to be found by the MFP and sent to the police. It would be a great trouble for police. To expose the lies of local police, the MFP decided to request a wanted circulation from Henan police. We made the request and offered £3,694.8 (50,000CNY) as reward for public notification for hunting former police Mr. Jiwei CHEN. The Henan police turned us down. On Oct. 31, we repeated our request and increased award to £22,168.69 (300,000 CNY) to the China National Police Headquarters for public notification of hunting former police Jiwei Chen. The China National Police Headquarters refused to accept an application from the MFP as well. Xinmi and Zhengzhou police came to the MFP for interviews and investigations about 9.6MFP bloodshed incident but didn’t accept the factual evidence we tried to provide them. They used misleading questions and changed our employees’ statement based on what they wanted. For this reason, our legal counsel Guijun QU, came especially from Beijing to the MFP and provided our employees with training on the general legal system.
